Have they said they will hold onto the cash for 120 days and then pass it on or are they proposing to return it to the RBL ? Normally on account closure all funds are returned less charges due obviously.

If they are intending to do neither of these things then you might as well start the small claims process now.

They are holding the funds for 120 days , eventually the topline manager I spoke to confirmed if no chargeback was issued by the cardholder they would release the funds to me , personally after today's experience I don't trust them , and no way am I waiting 4 month's for payment as they have closed my account anyway .

Perhaps if you were to tell us the whole story?

Start by telling us what the explanations are they have given you.

A 'business review' does not address any of the terms OhReally has pointed out to you. So what were the 'comebacks' of which you speak???

Basically they are not happy with the cardholder not present payment I took, so without warning they have closed the account , funds were due on tues , and they put a hold on the funds tues , the account was closed weds , I tried arguing the case that they closed the account after payment was due to me , but they keep reiterating on the "fraud prevention 120 day hold" which they can pull out of the bag at anytime by the looks of things .
They say I will receive the notice in writing that account is now closed , to be honest I've had a belly full of it , Just a little fish in a big sea trying to make a living , is it even worth arguing ?
The main problem I now face is 2 days loss of earnings which is not great .

With all due respect, none of that addresses the terms you were pointed to, and to which you claim they have a comeback for
(apart from, at a push, possibly withholding payment because of a potential chargeback. possibly fraudulent, etc)

To receive notice that the account is already closed is a contradiction in terms. You can receive notice of something that is planned to happen in the future. Or you can receive confirmation that something has already happened.

And none of this supports the allegation that they will "obviously" not pay you the money anyway.

I think some people allow their imagination to run wild once they get home.
So I'll leave it at that.

I'll be honest and say I'm not that clued up on legal jargon .
If anyone would be so kind as to look through the terms and point out if I have a leg to stand on it would be appreciated .
All I have done is taken a cardholder not present payment , which seems to have riled them enough to close my account without warning , that's all I can say :(
They may have said I will receive confirmation of closure , and regarding not getting paid , I can't wait 4 month's for payment , and as mentioned don't really want to do business with a company who can operate like this anyway .
