CCJ from TalkTalk?? UNKNOWN

Hi,

I hope someone can shed some light on my problem.

I recently checked my credit file (hoping to buy a house) as 5-6 years ago I got into some difficulties and stupidly got some defaults, I grew up, got my act together, got married and subsequently managed to cleared them and my file is now coming good but I have now noticed a CCJ on my file from 2010, the creditor is SC Gray Ltd and it was in Dudley County Court. Not know how this happened (cant remember a summons or letter corresponding to this) I telephoned the court to try and find out some more info on it, the lady on the phone advised me of SC Grays telephone number and to contact them. I then tried to do just that but was unable to get hold of them after several attempts so I called the court again and advised them that I cant contact them, The court did a search and then told my (cant remember the exact wording) but that the company was no longer practising and that I would would have to contact the company who the original debt and who instructed SC Gray to issue the proceedings was with I asked who that was and the told me TalkTalk.
I cant ever remember having an account with talktalk back then but rang them anyway (I am currently a customer of theirs).
I managed to get through to a manager of "collections" and advised him of what was happening, he told me quite explicitly that "TalkTalk never ever issue court proceedings or authorise there debt collection agencies to do that, they only ever issue "threats" to do that and if that doesn't work eventually after being passed around a couple debt companies it gets given back to talktalk and eventually after some time it gets written off"
So I asked why was there a ccj in my name from them? He said he doesn't know? so we search my previous addresses and it turns out that there has never been any accounts for those addresses? and he can't find any record of SC Gray ltd as one of their debt collection agencies?
So then I phoned the court back and told them this, they stated that TalkTalk would have to write to the court and say that this was made in error or something to that effect and it would have to go before the judge to be stricken off the register?
So then I called TalkTalk back and told them this....but they don't know who to speak to in the company to make this happen as they don't bring county court action.
Does anybody Know what I should do?? This is and has been affecting my credit for years and shouldn't be there.

    You could pay to try to have it set aside, but this will take time and they may well refuse the application-it also costs money. But have a read and see. TBH the CCJ will fall off your credit file in 2 years time so it may be easier to keep saving and working on having a good record and wait till it falls off before getting a mortgage.

    Otherwise only hope maybe to do an official written complaint asking Talk talk to remove. By doing things in writing it may force their hand to actually look into this and get it sorted.

  • thanks for the advice, I am hoping to get things moving a bit sooner than 2 years....paying £600+ a month in rent is rather depressing and iv rented for the last 10 years so would really like to get on the property market instead of wasting my money renting.
    I was hoping someone has had a similar experience and would be able to advise on how to complain? is complaining to TalkTalk my only option? Thanks

    I really and sincerely hope you get something out of TT. They are simply the worst company for various reasons and it is proved day in day out.

    Not only can they not read emails. They cannot get the jist of the content. They dont reply to telephone calls. They do not reply to letters. They do not listen to you. They do not understand anything outside of their script. They are patronising and rude. Need I go on..

    They have flashy ads but thats where it stops.

    I know for a fact that Im not the only one with age old problems with this outfit and I sincerely hope they step up for you.

    I would love to find out if they do. Will you keep us posted?

    Oh and another thing - a massive well done for turning your life around. That is some achievement and I hope that you will be able to get what you want in the very near future..
  • Hi, Thank you for your reply. It was really nice.
    As for an update on this I'm sure you all probably guessed this but TT is terrible! Iv been climbing their escalation ladder in there complaints department since my first post, nobody seems to know anything about it and I'm now waiting to hear back from there "executive office" for the past 2 days.
    In fairness they ring me everyday with an update but its always that they have had no response from which ever department they passed it to! And the apologise are never ending but still it doesn't sort my problem!
    Is there any ombudsman i could go to?

  • Update: Success!
    TalkTalk have agreed the information is wrong and that they will contact the court to remove the CCJ!
    Took a couple of months of trying and I even emailed Dido the chef exec of TT but finally got somewhere.
