CCJ Setting Aside Help

Any advice on this matter would be really helpful.
I recieved a CCJ earlier in January this year. I did not find out about this until applying for credit which was rejected in may this year, it was at this time that the CCj had been brought to my attention.

The CCJ had been put on my file from a private parking firm under the name PCN NW Ltd. Apparently the parking firm issued a notice in January 2013, for parking on land which was only for permit holders. The day In question I can recollect as I was parked on a University car park and was attending an exam in a building nearby. The car park in question had no signs, that were visible, no parking bays, and I always look to see if other cars are holding pay and display tickets which on the day there was none to be seen.

The problem being they have paid for my information from the DVLA, unfortunately I was not living at the address for much longer than when they originally fined me. I have never had a ticket issued on the car and have never had any documentation regarding court.

I have paid to have the CCJ set aside on the grounds that I have no recollection of any fine neither court documents as the address it had been registered to earlier this year I was not living at.

Since having set aside the order I have had numerous contact with their solicitor Gladstone Brookes regarding the order. They have advised me to accept invitation to withdraw as they hold very good grounds in winning the case. I have evidence to supply from my local council I did not live at the address at that time. Today I recieved a phone call from the solicitor again, informing me to pay the costs and they will set up a new order to the court, so that when I turn up at the hearing there shall only be me there, apparently this may persuade the courts to set the CCJ aside? As you can understand there is no guarantee of this happenning and I am not sure whether they are just trying to get me to back down as once I have paid the monies, I could still be left with a CCJ. They do hold pictures of my car at the time of issuing the notice with the penaly attached to my window, however I had never come across this. What worried me even more is that the the total costs are at £260, as the fine was originally £100, surely they cant charge this much. I am trying to collate as much evidence on this parking firm as possible, as it stands there is not much that can be done, as they are a member of the BPA.

Any help regarding this matter would be really helpful.

    Why was your vehicle registered to an incorrect address?
  • Hi,

    It wasnt registered to an incorrect address, I had moved house and sold the car approximately 4 weeks after the incident had actually occured which I have proof of. They may have aquired the driver information at a later stage probably well after the incident.

    So you had no postal redirection notice on the property?
