TPS & PS "Letter Before Claim"

  • It was a retail car park. I was actually doing some repair work at the site, tried to park at the "tradesmans entrance" but there was no space. So parked at the front. I wasn't actually parked for 4 hours which is why I am furious about the ticket. I will contact the manager of the store (should still have there details in my log book) and ask them to help.

Further, you state that the Letter Before Claim is non-compliant with the Practice Direction on a Pre-Action Conduct. Your assertion is firmly denied.

Surely if the LBA is not compliant it must be easy enough to point out to them where it does not comply. Make them prove that it does comply, the more you make them work, the more they will charge their client.
You never know how far you can go until you go too far.

And if he/she is unhelpful then escalate the complaint to his Area Manager or Head Office.

  • Ok, so Next arent being too helpful. They are asking me to contact my imidiate line manager at my company and deal with it through our company procedure.

Problem is I dont work there anymore! Any advice on which department to be put through to? I phoned the head office and the lady on reception advised me to speak to HR, but it was after 5pm so they had finished for the day.

Does this seem like the best course of action?

    Thanks for the help

Put it on Social media - Twitter & Facebook. I reckon Next will soon jump! We see this tactic work a lot with retailers.

  • I called Next head office and they gave me the number for the site where I was working. The girl there seemed to know the situation all too well and said she would cancel the PCN for me. She said she would forward the confirmation of cancellation too. Not recieved anything yet, but also heard nothing more from TPS, or Premier so hopefully this has been put to bed.
Thanks for the help and advice
