Executor of will... please explain

Can someone clarify a few points for me:

What is an executor and what, if any, powers have they?

What is their role were a will is concerned?

Can a will have one executor?

Who usually acts as executor?

Any further info or advice would be appreciated.

Should the individual acting as executor have access to what is being left in the will?

Can an executor change anything in the will after the owner dies?

An executor is someone who executes the Will - that is they carry out the wishes of the person who has now died.

There need be only one executor.

An executor can be a solicitor who has helped draw up the Will. A family member or friend is another possibility. They can be a beneficiary (though beneficiaries cannot be witnesses).

They have to have to be able to ensure that the person inheriting any asset is able to receive it.

An executor cannot change what is in a Will - though the Will may give them some discretion in what is done, the authority to do so has to be explicitly given.
  • Thanks for the reply.

Am I correct in thinking that the executor also organizes funeral arrangements?

Oops - pressed thanks not quote! As Little voice says the executor's role is to execute the wishes in the will. They don't necessarily organise the funeral as well -that's separate. Of course, nothing to stop it being the same person.
