Help It Went To Court Without Me Knowing

Hi everyone
I'm in a right situation now and could really do with some help and advice, I tried to reclaim charges from ABBEY, they wouldn't pay up, so i took them to court, doing my claim on line, I must say i have never been really sure on what i was doing, but plodded on anyway and have since been advised they as i am unemployed i need not have payed the costs (but i did).
I then got a letter from the court headed
GENERAL FORM OF JUDGMENT or ORDER. It goes onto say
The court has made this order of its own initiative without hearing. If you object to this order, you must make an application to have it set aside, varied or stayed within 7 days of receiving it and the court be minded to strike out the claim on the grounds that it discloses no reasonable grounds for bring a claim against the Defendant
IT IS ORDERED THAT
Claimant do by 4pm on 15th June 2007 file in court and serve on the defendant amended particulars of claim setting out details as to why the claimant says that she is entitled to claim against the defendant.
It states i should file in court by 4pm on 15th June But i never got the letter till after that date, I have kept the envelope it was posted in and the post date stamped on that is 18/06/2007.
I thought all was lost and so i guess kind of gave up, with depression and mounting money problems i again started to bury my head in the sand, then speaking with my sister She advised me to come on to Martins Site and put it out to all you good people, in the hope you would be able to give me some sound advise that would get me back on track with reclaiming my bank charges.
So i would be extremely grateful for any help, I am not even sure I am doing any of this correctly as this is my first time writing on a forum, I am just going to press the send button and keep my fingers crossed that some how it ends up in the correct place and somewhere a long the way I will learn how to locate any feed back given .

  • From my reading I think you are going to have to start again because the likelyhood is that the case has been thrown out. I would ring the court tomorrow with the claim number and explain what you have posted and ask them what you need to do and whether the claim has been lost. Post here and we will get your money back for you.
