employment and support

please help i have had 2 appeals overturned in my favour still on the basic money and have just had third assessment and that too have been told fit for work so have asked for it to be looked at againand told i do not get any money until decision is made. but yesterday got letter to go to work-focused interview for employment and support allowance claimants. i thought people who got this letter had been put into the work-related activity group.

    I had 2 assessments and both times i asked them to look at it again .the first one was overturned because they mixed me up with someone else. and the second overturned as the medical report was find not fit for porpose. the third i got last week ,i phoned to ask for mandatory reconsideration and told no money until they look at it again. but i have just got this letter about work-focus interview if i got work- focused interview does this mean i'm in work- related activity group and so should be getting esa. I have been trying to get esa since june 2012 and until 1st october was on basic rate now no money.

    It would help tremendously if you could give some dates as to what has happened, the results and the amount of money you have received each time.

    You seem to be saying that you have won two appeals but have never been put into a group and have remained on the assessment rate for years?

    yes that is correct 29th sept 2012 was looked at again overturned and referred to medical services to start work assessment process again. medical on 25/03/2013 decision made by appeals officer on 14/5/13 overturned medical report not fit for purpose back on basic rate £71. now the third in the mandatory reconsideration stage, no money until looked at. but have been sent letter to go to work-focused interview for employment and support allowance claimants. not been put into a group at all

    so they havent been appeals in fromt of a tribunal?
    just reconsiderations?
    it seems like although they arent failing you for ESA, the are asking you to undergo further work capability assessments in order to actually group you.
    seems really strange and am not sure youre giving us all the information needed in order to help us understand whats going on

    A couple of points here:

    First of all while you are at the mandatory reconsideration stage you could claim JSA as you have been found fit for work.

    It is possible that they have reconsidered already and a decision has been made to put you in the WRAG group.

    All seems a bit quick though. Possibly just a mistake.

    You will have to ring them tomorrow and find out what is happening. No use our second guessing. Good luck!

    the first assessment sept2012 was overturned because they mixed me up with someone else so had to be assessed and second 25/3/13 medical was not fit for purpose third 18/9/14 waiting for mandatory reconsideration, so i am not getting any money until they look at it again. so why the work- focus interview, i don't understand.

    You have been on £71 & £72.40 all the time on ESA since 2012.
    You have been sending in sicknotes for 2 years now.

    You have had three medicals.

    If I were you, I would

    a) i) Phone the ESA and ask what is your award rate shown as?
    ii) Ask what the latest decision is showing as in screen 791
    iii) Ask if there are any notes about having WRAG.

    b) Phone the Jobcentre (number should be on the letter you got) if not use 0845 6043719 / 0345 604 3719 ask for a callback from your ESA advisor, and ask them why you have this letter, when your records are showing "ESA disallowed".

    thank you .I phoned today no news about wrag still waiting mandatory reconsideration. but they did say because no money until sorted i can claim jsa. under a special rule , i said but that would be saying i am fit for work and i am not that is why asking for recorsideration. they said no that is why under special rules and have interview tomorrow. is that right or am i being tricked into JSA. need to claim worried about housing etc

    Yes, you can claim JSA. You have been found officially fit for work so are eligible.

    Do not show Job Centre Plus your fit note - causes problems. Ask to see a disability advisor. Job Centre Plus should sort out your HB and CT reduction so you might want to ring the council to check that it has been sorted.

    When they have reconsidered, if the decision is the same then you can go to appeal and go back onto the assessment rate of ESA (you need to tell Job Centre that you want to do this.)

    To get JSA you have to say you are able to work (the DWP have just told you that you are able to work)
    And that you are looking for work.

    You will have a Jobcentre interview, where you will say you are on ESA Man Recon and will go back to ESA when Man Recon is done,

    The jobcentre will be very light touch with you and won't be harrasing you do what normal jobseekers have to do.
