Unlikely that she will be able to get an immediate divorce either, she would have to wait 2 years.

I've always understood that joint bank accounts can only be closed on the instruction of both account holders.
.................:)....I'm smiling because I have no idea what's going on ...:)

Has she any pensions? They are regarded as assets of the marriage and he may be entitled to a share of them too.

    MSE Florida wedding .....no problem
  • Either party can petition for divorce immediately on the grounds of unreasonable behaviour.

A financial order is required, without it either party leaves the door open for future claims (unless the beneficiary remarries although pension sharing is still possible)

As he is not working due to ill health, there is presumably a large income differential between them so she may be asked to pay spousal maintenance if she has spare disposable income after reasonable needs are taken care of. The court will consider the likelyhood of him being able to get another job, and in what timeframe.

As a previous poster suggests, pension values for both parties are relevant and will be added to the matrimonial 'pot' for offsetting or pension share.

Seriously?! I find that pretty shocking if that is true given that there are no children involved.....

Do you mean morally rather than legally?

When I divorced my ex I did it all myself and due to us having no house, children or savings it was all pretty easy (in spite of the fact that he was not willing to comply).
She can definitely divorce him straight away as they have been married for 7 years.

I think that's incorrect and utter nonsense.

I was thinking that too. I know if he runs up joint debts she'll be liable to half but that's about it .

Can you imagine the abuse on her if it was a man leaving his ill wife

Not quite. Whichever party the lender can catch up with is potentially liable for the lot. If one partner goes missing then the one they can find could end up paying it all. Normally lenders won't split it.
