Good morning all.
I recently received a charge notice from UKPC for my partner exceeding the allowed time when meeting a friend for a catch up at a macdonalds.
I have checked the first post and have looked at the legislation para 9 and the notice looks like it meets the legislation.
Based on the above do I still have a right to appeal, or is it just delaying the inevitable?
If an appeal is worthwhile and I send the template letter should I remove the line about the notice not being in accordance with legislation, or do I leave the template as standard as stated in the thread?
Any help would be much appreciated.
Kind regards
A.

It wont matter if you appeal stating Martians abducted you, they will reject it, all you need is that POPLA code.
You might want to start creating with MCDonalds as well.
Or next time take a stick with you to push the food down your throat faster so they dont try and rip you off via their parking agents.I do Contracts, all day every day.0 -
Read the Sticky thread for NEWBIES that tells you how to appeal, win, and cost the PPC money.
Was this in England or Wales, or Scotland or Norn Iron as the advice is different?
Do not pay, do not ignore, do not reveal who was driving. Do nowt until you have read the NEWBIES thread.
Tell your partner to complain to Mucky Dees like billyo, and then never go to one again.I married my cousin. I had to...I don't have a sister.

I will send the first letter tomorrow and keep my fingers crossed.

Don't send anything until you have read and understood the process in the NEWBIES thread. Mitigation doesn't work so only use the appeal points in the template in the NEWBIES thread.
You won't need to cross your fingers as MSE has a 100% record of winning PoPLA appeals provided people follow the advice given here.I married my cousin. I had to...I don't have a sister.

Thanks fruitcake. I read the sticky and the legislation as requested.
She lost track if time so exceeded the limit and the notice looks be in accordance with legislation so was just checking to see if I still was in my rights to appeal and of the appeal was likely to be fruitless.
FYI I am in England.
I will send the appeal template and keep my fingers crossed.
Thanks again0 -

Don't be conned by anything a PPC tells you, there is no legislation and no regulatory body where these companies are concerned. They do all sorts of nasty things to get people to pay. The only thing that matters is that you appeal using the template letter. This WILL be rejected but you use the PoPLA code that MUST be supplied with their reply. You use the How To Win At POPLA section of the NEWBIES thread and win.I married my cousin. I had to...I don't have a sister.

Why delay the inevitable when the inevitable requires that you will pay nothing, the PPC will pay £27.00 (plus v.a.t.) and the BPA another £100 or so.You never know how far you can go until you go too far.0

Not inevitable that POPLA will be next, this is the norm for UKPC when they see our appeals, they bail out:

OP don't be confused that the suggested first appeal has changed - I often change it to keep them on their toes! Use whichever version you like best!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
