Help with debt

Hi,i am new to this so not sure this is even in the right board to post.
I am actually getting advice for my partner,2 things,firstly yesterday she had a court claim for an orange phone contract,it is asking for £225, it is her debt so she is willing to pay upto£15 per month,we have not filled in the form yet but she has had a Brain Heamourage and can not work and gets less than £100 a month,do you think they will accept 15 a month if we write a letter explaining her situation,also do i have to fill in all her financial details on the form?
Secondly she has £1000 on a catologue,she has been paying £20 a month as agreed but she struggled so changed it to £5 a month for a couple of months,they were not happy and said the agreement ends and they will take legal actio,could they get one of these court claims as well even though she has still been making payments?

    Firstly, it's great you are taking steps to help your situation. Secondly, I wish your partner all the best of health.

    Have you included all debts? You could write a list of all debts (creditor name, account number and amount owed) to see exactly what you need to sort. Then you need to do a chart of your in comings and outgoings. When it comes to outgoings include everything. Even things like birthdays. Then you can look at what money you have spare and what you can pay to creditors.

    There are free debt advice companies who can help. Payplan and Stepchange are two. They are great with advice on how to deal with debt and what avenue you can take. Have you thought of going down the debt management plan route?

    Whatever happens, don't stop making payments but do contact the creditors to explain you are experiencing financial difficulty.

    Honesty, once I made contact with payplan, I felt assured and in control of things for the first time in years. I really wish you both all the best. Good luck!
  • She should have defended the court claim, or asked a representative to do so.
    Mobile phone companies very rarely indeed have the correct paperwork, contract and proof required.
    They generally sell on to debt collectors but never let them have the correct paperwork.
    To be honest, it has all been left a little to late, the water is over her head now.
    All she can do is fill in the form with expenses and be meticulous in listing everything she has to pay out, do not make any offer, let the court decide.
    They often come back and say pay £1 a week where exceptional circumstances exist.
    Start drawing up some cost of living accounts and do not forget the pounds shillings and pence.

    As for the greedy catalogue debt, call their bluff and make sure they know she has one CCJ and if they want to chance getting a £1 a week as well then she will gladly go to court.
    Make it clear to them
    Any more threats and the payment stops dead if they are refusing to accept it and they can take their chances at the court with everyone else.

  • Thanks for the help, she is feeling better now, she says that she had no threats before the court claim but as shehad the heamourage she forgets most things so it may have been sent...Thank you though

    I would phone Stepchange asap (have a look at their web site first), with your GF with you, and ask for their advice. If these debts do go to court, her circumstances would be taken into account, so please tell her not to worry.

    Hello :)

    As above states, I would contact step change with her and tell them about her situation. From experience, when someone I know explained to those they owed money too, their medical situation (backed up with a CAB reference number) they seemed much more complying with arranging a suitable payment plan. I think you just need to let them know.

    If these are all her debts - they aren't huge and tell her not to worry as this could make her worse...and she doesn't deserve that.

  • Hi there, never done this before so not sure if I'm doing this correctly or not! Just wanted some advice please....
    I've had a barclaycard since 2001, quite high interest, I've racked up debt on it but over time eventually paid it off hence over time ive had my credit limit increased to £12,000. Early last year I owed £4,000 on it but knew I was going to receive some inheritance as my father was terminally ill. Knowing this I spent another £4,000, treating my son to a holiday, birthday party, house renovation etc as I was going to use my inheritance to pay it back in full. To cut a long story short, I never recieved the inheritance so couldn't pay the debt off in full. Since spring ive been paying £300 a month to pay it off but £150 automatically is taken for interest. I know if I could get a credit card 0% balance transfer or a very low interest loan then I could easily pay £7,000 back (which I now owe) within two years of payments of £300 (or just over) a month. I've checked my credit score and it was rated 'good' with no negatives only showing the outstanding debt owed on my barclaycard. Just wanted to know the best way to secure £7,000 of low or interest free credit to pay back this debt asap!!!

    Look on this website, they list the best loan, creditcard rates available, that's if you think this is the best option for you, you would be well advised to cut the Creditcard up first.
