You have to be realistic about what you will gain/lose from a court case. If you could convince a court that you have missed out on 100 email enquiries - how would you then quantify your loss?
You could argue that you would have converted 5 of them to contracts, so you have lost £x, I still think it would be in hundreds, in the unlikely event of you winning.
A solicitor's letter however would only cost you a few tens of £ and may encourage some sort of compensation.

This is an interesting question.
Years ago I had a company build me a website, I had to sign off at the end of the project that I was happy with everything and it all worked, it was my site and my responsibility to check it worked properly.
Just out of curosity...how did no-one notice that you weren't receiving email enquiries for four years?
And also if you web form hasn't been functioning for all that time and no-one has complained that their email wasn't replied to, are you getting much business from the site at all? It is ranking anywhere near the first pages on Google?0
