Failure to pay the parking charge....

If a Parking Charge Notice threatens (as they often do) that a debt collection company can be used to recover outstanding parking charges from the registered keeper, could this not be appealed against as a 'technicality' as it contravenes the law? I understand the only way they can recover costs is through the courts.
