WTC & CTC overpayment

My daughter has received a letter today dated 29th September 2014 saying the following:-

NOTICE TO PAY Section 29 (3) of Tax Credit Acts 2002

We have sent you a notice showing an overpayment of tax credits for the period ending 22/07/2013

The total amount you have to pay back is shown below and is due by 06/11/2014

The total amount of Working Tax Credit overpaid to you is £388.96

The total amount of Child Tax Credit overpaid to you is £464.49

The total amount of tax credits overpaid is £853.45

You have three months from the date you received your award notice to tell us if you think an HM Revenue & Customs error caused this overpayment.

Information on how to pay is shown on the back of this form. You may be able to spread your repayments over a longer period. To discuss this please phone the Payment Helpline on 0845 302 1429. Please have your bank details, sort code and account number ready when you phone us.

My daughter does not recall receiving a notice showing an overpayment.

Does anyone know when she would have likely been sent this notice?

Would it have been around April 2014?

Thanks in advance.

Thankyou for the reply, So if she rings the tax credits and asks them for what period the overpayment covers (date from until 22/7/13) and what income figure they have used to work out the overpayment, this should then hopefully shed some light on this?

Yes they can confirm the amount of overpayment, period covered, reason for overpayment, when paperwork was sent etc. the overpayment may not necessarily be to do with income but without knowing the circumstances it would be impossible to suggest what the cause may be.

My daughter was a single parent (split with the father of her son soon after he was born, nearly 7 years ago). She moved in with her current partner on 20/07/2013.

When she received her renewal for TC this year they asked for the period Aug 2013 to April 2014, she sent these figures off and received a letter saying their records showed different and therefore needed figures for April 2013 to April 2014.

The renewal for would have shown the award ran from those dates but it always asks for income for the full tax year.

Am I correct in thinking they may have used the joint income April 2013- April 2014 when the joint income should only be taken into consideration from when they moved in together.

It's amazing the number of queries you see on here saying such letters have not been received, strangely, I don't recall a single one not received resulting in a claimant receiving more than they should.
  • can I request my tc overpayment be taken slowly from my current reward? it is not being recovered from my current award. It is like a debt I have to pay back separately and there are other charges on top as well. Its a real difficulty to pay back.

    miss james,

dont mean to sound petty or nasty, but maybe it would be better if you started your own thread instead of posting a question on this thread, to save confusion, as posting on this thread means there are two queries and people will be posting answers to both queries. x

She does have her own thread but it mentions housing benefit so has probably been missed.

Ok x, but still confused as to why she has posted a query on this thread x
  • sorry I should start a new thread, but very simply yes it was from another claim. I was on jsa then working again. I wish I could pay back out of my current claim?

If I do nothing what will happen? will there be many other charges for late payments etc? I cant afford to pay it all.
