    I think it's YOU who has the wrong end of the stick.

    I do not think so John. I have just googled three legal websites and all state that a WP offer cannot be used in court against the offerer, which would not be the case here.

    However, I am not a lawyer, which, from your profile signature, you appear to be, and am only too happy to be persuaded otherwise by legal argument.

    Magistrates' Courts try criminal cases. Civil claims, such as private parking, are heard in the County Court before a District Judge.

    I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

    That was a waste of time then. One search 'How to win at POPLA' on Google finds this forum and the template winning appeals already written for you to copy.

    Luckily for you this is CEL but they DO send court papers to victims! So, please when you get those, research the defence better than you researched the POPLA appeal.

    Clue - we have loads of CEL cases going to court stage and no-one loses. It's all here in the forum and we don't make £40 offers nor mark our letters 'without prejudice' either. In fact defendants we help who go to a hearing end up claiming their costs from CEL at up to £100 a pop.

  • It wasn't particularly advice, the title of my posting has a question mark after it. I'm beginning to wish I'd never bothered. The responses I've had range from mildly useful to outright ridicule. Obviously I'm not as widely-read on the subject of parking tickets as the average forum member, but frankly I've got better things to do. Good luck to one and all.

    I have to say that I sympathize with the OP, the standard of replies from some long standing members has been pretty dismal, two have failed to understand the points he was making, and a third may have given incorrect advice concerning the legal position.

    But you will need us when CEL send you a claim form because we know what to put in a defence & we know they don't turn up. I posted out of frustration - it's October and you are the only person I can recall this year who has managed to lose at POPLA v CEL, so that was such a needless waste of the second stage appeal.

    Almost all posters here have never had a parking ticket before and have better things to do than a decent POPLA appeal - but they Googled it first & they all win.
