Blackpool Car Park

Please could you read this an advise, my personnel details have been omitted.


On a visit to Blackpool I parked in a Council Car Park.


Looking at the regulation board it stipulates that a Disabled person may park in any bay for 3 hrs free as long as they display their badge the right side up and their clock depicting the start of their stay.


It went on to say that:- If that person wishes to stay longer than 3 hrs they have to purchase their ticket at the start of their stay and place it where it can be seen clearly.


Now I purchased a ticket for 2 hrs and placed it alongside my Blue Badge but did not display my clock, hence I attracted a PCN for the sum of £50 payable within 28 days, OR £25 if paid within 14 days.


Now in all fairness, I purchased a ticket for 2 hrs, expiry time 12:03pm (therefore my arrival time would be 10:03am) plus my 3 concessionary hours will allow me to park legally till 15:03pm.


Yet I had a PCN timed at 13:38.


I wish to dispute this and would like your thoughts on the letter below.

I wish to dispute the PCN I attracted on 7Oct 2014


I arrived at your Central Car Park FY1 and purchased a ticket for 2 hrs and placed it on my dashboard alongside my Blue Badge which entitles me to 5 hrs parking.


I did not display my clock as I thought it unnecessary as the expiry time on the ticket was more than proof enough to ascertain what time I arrived at the car park (ie 2 hrs prior to the expiry time).


The expiry time on my 2 hour ticket was 12:03pm (arrival time therefore would be 10:03am) which with my concessionary 3 hours would entitle me to park until 15:03pm and my PCN was timed at 13:38pm.


Now had I not wanted to stay longer than 3 hours my time clock would have been displayed to show my time of arrival, but it is clear that the time on the purchased ticket is infallible proof of my time of arrival which cannot be misinterpreted.

    As you did not display your clock, I cannot see why you think that you have a case. You parked at 10.03 am and paid for two hours. Without a clock on display you were not entitled to a free period.
    You never know how far you can go until you go too far.

    Technically not (perhaps), but the OP also said:

    'Now I purchased a ticket for 2 hrs and placed it alongside my Blue Badge'

    ...and that ticket was printed out on arrival and shows an exact time - in fact it's a better record than a parking clock would be as it's down to the minute of arrival and cannot be tweaked by a person setting their clock a bit wrong!

    This is just the sort of case pepipoo can help the OP to win - if not at formal appeal stage then at adjudication. I will eat my hat if an adjudicator doesn't agree that there was no contravention under these circumstances!
