Not so sm*rt parking

Hi there wise ones,

Was hoping to get some advice with regard to a parking notice issued to my wife at a well known shopping retailers, whose car park is 'managed' by notsosm*rt.

I won't go into the specifics of the ticket at the moment, but needless to say an 'invoice' (no offence to real invoices meant), was left on my wife's car around 6 weeks ago. I searched the forums, and following the advice on here, sent them a letter stating facts and such and awaited the outcome, fully expecting a 'not on your nelly, here's your popla code and pay up' return letter. However, to my surprise, they sent a reply saying they were examining it and would be in touch within 28 days.

We are now on day 29 and no response has been received, so would it be best to send them a letter stating that as they had used their allotted review period, I can consider the case closed and not entertain anything further from them, or is it best to carry on waiting and then use this late return of review as part of my challenge when they finally do decide to try and press their case?

Any perspectives/opinions would be much appreciated and much valued.

  • Don't send anything till 35 days after your appeal. At that point you can, if you wish, contact them and state that the BPA Code of Practice says the must make a decision within that time or, if not, tell you why and when. Their silence is therefore taken as an acceptance of your appeal and you consider the matter closed.


    Not that it'll make any difference.
