Hi all,
I have done sooo much reading on this and looking through the templates ect, so much so my head hurts!
I can't seem to find a template that suits my needs, so I was thinking of using parkingticketappeals to do the work for me. But before I do this I thought I would start a thread and see what help I can get from you guys.
I will briefly explain the situation;
- Parked in Lusty Glaze beach car park (Newquay), the machine only took coins, no other method of payment offered. I was going out to sea for some hours and had to be there for a cetain time so I was in a rush. Long story short I didn't have enough change to buy a ticket with enough time, nor was there anywhere/anyone to get change from so I put all the money I had in anyway hoping that it would give me a little more time as I paid more than one of the tickets (£3 instead of £2.50)...It didn't, obviously. So I just bit the bullet and hoped i'd be back in time or no traffic wardens would pass.
- I was 20 minutes late past my ticket and surprise surprise I had and effing ticket too!! (10/06/14)
- I ignored it as it was private and I thought it was unfair as I could have paid by card or cash but there was nowhere to put it!!
- After a few weeks I got a 'Formal Demand' letter (13/08/14) stating I now had to pay the full £100 as I hadn't made a payment and they had evidence ect ect.
- Found a template to use as an appeal (Didn't state about the machine not taking card or notes. Nor did I say who was driving)
- Obviously it was rejected (09/10/2014). In the letter they sent me today they have includede a POPLA code and copies of the pictures of my expired ticket. However they have also included pictures of the signage that were not taken on the day they took pictures of my car if this helps.
ANY help will be greatly appreciated
Cheers, Dan

Just adapt an example POPLA appeal shown in the link 'How to win at POPLA' in post #3 of the NEWBIES sticky. You want a windscreen ticket example, then make sure you add into it the fact that there is no keeper liability as the 'Formal Demand' arrived too late and with significant wording omissions, both of which mean Armtrac have failed to meet the second condition for keeper liability under Schedule 4 of the POFA 2012.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
