JAS reply to POPLA- is this normal?

Options
Hi all,
Had a reply from POPLA today where they attached the response from JAS. It's got me worried!!
Please note, before I searched online and realised that my charge was 'appealable' I emailed JAS and explained the situation and felt that they were being unjust. I obv realised this was wrong action too late so started my appeal as suggested on the site. I also had my appeal letter checked on here in an earlier thread.
What do you think??

Dear POPLA,

Please find attached our evidence relating to the above case.

Please note that the appellant his submitted a copy a paste appeal format from the internet to try a get out of paying for a correctly issued parking charge notice.

As you can see from the correspondence the appellant has stated that they left the car park to go elsewhere, this is a breach of the car park terms and conditions.

Our terms and conditions are clearly displayed on 10 bright yellow sign boards that we have throughout the car park.

The appellant was given a 10 minute grace period to return to the car park before the parking charge notice was issued. The appellant has also not submitted a receipt to be considered with their appeal.

Please consider all the evidence carefully as there has been a clear breach of the terms and conditions of the car park.

Thank you

Adam

Please consider all the evidence carefully as there has been a clear breach of the terms and conditions of the car park.

You should have added to your original thread so we can see the whole picture of what you've received and done so far, and what you've said to POPLA.

If you've added a GPEOL paragraph to your POPLA appeal then the fact that JAS say you've 'breached' their conditions, that will win for you.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

That's it? That's all they submitted? And you're worried by it?

If you mentioned "not a GPEOL" in your PoPLA submission then you're home-and-dry.

  • What's GPEOL?

Sorry, that would've made more sense to do that? Should I attach my appeal letter here?

    Thanks, x

Jeez, you obviously picked your forum name for a reason!

I've traced your original thread and GPEOL is the first paragraph of your POPLA appeal. I'm not going to tell you what the acronym means - so go back and check your original thread, then come back here and tell us what GPEOL means!

  • ok ok! I appreciate your help but don't get too frustrated with those of us that are totally new to this! I'm good at what I do and have a lot to remember, its just not this unfortunately and life outside my job gets somewhat forgotten about!

thanks both of you for that, it was reassuring. Just sit and wait for popla decision now then?

    Thanks.

What a daft defence by the PPC. Of course people use PD material to inform themselves about scams.

However, I get the impression that the OP has little understanding of the points she raised in her appeal, it is a good job she will not be cross-examined.
You never know how far you can go until you go too far.
  • Thanks, I am still here so you could've replied without referring to me as 'she'.
I do get what I have written but as I said, this is all new, acronyms and certain terminology does not roll off the tongue and yes maybe I didn't word all of my letter perfectly but I used several to select parts out of carefully.
All things considered I think I'm mudding though ok, thanks to the support of people on these forums.
Just don't assume or infer that people are stupid (my word I know) just because something is new.
    Thank you
  • Hi

I am sure that the letter was included as part of the evidence pack submitted by JAS .....

Please do a simple rebuttal - this is now proving imperative for all POPLA appeals.

Their contracts / witness statement supplied is usually next to worthless
with blanked out parts and omissions - and therefore simply rebut this that this fails to provide any authority to issue or pursue parking charges on this site.

The GPEOL statement for their alleged losses also needs a simple rebuttal. Unless they have changed it recently - they are including costs in dealing with the appeals processes and POPLA.

Do a simple forum search and you will find how to rebut this as PTAS has shared this and CM has included on several threads - though for other PPCs

PLEASE ENSURE THAT THE REBUTTAL IS TAILORED FOR YOUR PCN.
  • Great advice, i'll be on this tonight. Thanks.

Why does he use the name Adam

You may wish to post up a copy of the loss document to see if they have changed it. It would be worthwhile you doing that so any changes can be spotted and countered.
