I hope somebody can help me as I am posting on my DIL's behalf.
She received a CCJ just over 6 years ago, she made monthly payments and then received a letter from the DCA collecting the payments telling her to stop making payments so she did.
Last month the CCJ was removed from her credit file.
She has now received a letter from a new DCA asking her to contact them to make arrangements to pay, which, of course she is willing to do as the debt is still outstanding.
So, my questions are, can the new DCA put the CCJ back on her credit file? and also, can she still make the repayments that the court agreed and if so, how does she tell the new DCA this?

The answer is a definite 'no'. Neither the CCJ nor the initial default can be put back onto her file. That does not mean however that the debt cannot be enforced - it can be, and as a CCJ is in place it would be fairly easy for the creditor to take enforcement action if no payment is made. So your DiL is quite right in re-starting payments.
I am a little surprised to hear that the DCA did not want further payments. Usually a debtor should continue to pay in a accordance with the terms of the CCJ. That is of course the debtor's right and the terms can only be varied by the court not the creditor or the agent.0 -
