Property - New Build Rights

Hi all,
First time poster so hopefully I am in the right place.
I bought a new build property in October 2013. Since then many issues have occurred including the plaster work in the apartment becoming boast. A builder surveyor recommended that the whole apartment be replastered and looking at the initial costs it is over £6k.
The developer was informed of this in April and stated that he is not responsible for the property and it was a warranty issue. At this stage I found out that I was not covered by NHBC (should my solicitor have informed me of this?) but covered by Global Homes Warranties. There was an excess on this of £1000 which I stated I would not pay so the developer mentioned he would cover this.
Since then the claim was rejected on the basis that it was not "structural" and the developer is ignoring me.
My solicitor claims we will sue him which is ok but I feel like I have been mislead. The NHBC warranty is crucial to new builds and properties in my development are covered by it up to number 24. I happen to be in the 30s.
And I am not sure my solicitor has considered the implications. Is the developer no longer responible?
Any information and advice would be really helpful!
