Nationwide Section 75 Claim Consumer Credit Act - Problem!

Has anyone had problems with a Section 75 claim against Nationwide Credit Card Services? I have submitted five sets of documentation to establish and substantiate my claim, yet Nationwide claim that they have not received anything from me and have rejected my claim.

    If they keep losing the documentation then I suggest you send it once more, by post. Get proof of posting (free from the post office) and hang onto it. If they lose it again then you have evidence and can make a complaint.

    If they keep losing the documentation then I suggest you send it once more, by post. Get proof of posting (free from the post office) and hang onto it. If they lose it again then you have evidence and can make a complaint.
    You'd be better to get proof of delivery (chargeable but meaningful) rather than proof of posting if you're wanting to demonstrate that they've actually received something.
  • The last set of documentation was sent from one of their high street branches via fax, the Member of branch staff who sent it confirmed that it had been received, yet Nationwide continue to claim that they have not received the information and have refused to consider the claim. The postal address they give is a PO Box my local Post Office tell me that mail sent to a PO Box can't be signed for.

    I know that the banking industry are unhappy with the Section 75 legislation and they appear to do everything possible to avoid considering legitimate claims from consumers.

    Looks like my only option is the Financial Ombudsman.

    The FOS will expect you to go through Nationwide's formal complaints process before they get involved, so try that first....

    Really? Sounds like someone there needs more training ;)

    I've sent 'signed for' mail to a PO Box before, no problem.

    In fact even the RM website suggests it's possible

    What if mail has to be signed for?

    When you come in to collect your mail, you will find a ‘something for you‘ or ‘fee to pay’ card with your normal mail. If anything has to be signed or paid for you can do this before you leave the delivery office.

    Only international mail intended for a PO box or similar will not be accepted if you want a signature on delivery.

    No, never had a problem. Nice people to deal with, kept me up to date with progress, and we reached an amicable settlement.
