Unsolicited Goods

Hi All,

I'm hoping someone can help please.

We recently received a delivery we were not expecting. We do comping on here, so it's possible it's a prize but we havn't been notified of having won anything, so it could also be an error by the sender.

We will likely contact the sender about it, but before doing so I just want to check where we stand. I believe this is unsolicted goods and that legally we could keep or sell & that if return the item it would be arranged by the sender at their cost?

This has got me thinking about something that happened in the past, where an item was collected for repair and we were given a loan item in the mean time. We had to contact the sender to request they pick up the loan unit. What would happen if we hadn't done this? Would this also be unsolicited goods?

    For the latter case the answer is unequivocally No - they were not unsolicited goods.

    For the former case - Perhaps. Was the package addressed to you (or someone in your property)?
