failed esa but assessor keeping me on it?

Options
I have just had a phone call to tell me I failed my esa assessment. He asked me a few questions then said "you have failed but after talking with you on the phone I have made the decision to leave you on esa for a few months (3-6) and then we will send for you to have another assessment". After putting the phone down from a call which has made me feel very sick and shaky I am still in confusion. Have I been put on wrag? Support group? Still on basic pay? I didnt think to ask as I was so shook up from the call. Any help would be great thanks.

    The simplest thing is to ring again and find out - better than worrying about it!

    I have just rang back and they said they are puzzled. There are no notes on the system to say anything has changes or that ive even had a phone call? The man I just spoke to said its not normal practise. You either fail and your kicked off esa or you pass and youre put in a group so Im still none the wiser?

    It is possible that the computer system hasn't been up dated.

    So, your options are, phone again tomorrow or wait until you receive your decision letter.

    I must admit I've never heard of it either.

    Please try not to worry. Your money shouldn't stop without any notification.

    The assessor cannot as I understand it choose not to make a decision on your case if you are being paid the assessment rate.
    They cannot choose to continue you on the assessment rate.

    If you are being paid the WRAG or support rate, they can extend this by a few months.

    It's entirely possible that the person who called you and made the decision didn't put any notes on the system. That shouldn't happen but does, maybe they got distracted - who knows.
    It sounds as if the Decision Maker at DWP called and, although ATOS hadn't given you enough points to go into one of the groups, the DM decided that you would qualify albeit for a short time only before needing to be re-assessed.
    It is absolutely not true to say you either pass or fail. One of the major jobs for the DM's is to look at ATOS decisions and interpret them. They are not supposed just to rubber stamp ATOS assessments.

    So does that mean I am being paid at assessment rate still until I have to go through all these shananigans again in a few months? I wish they explained things a little better so you didnt have the extra worry.

    Well ultimately that is exactly what does happen you either pass or fail.

    OP,
    You will have been awarded either WRAG or SG, you don't need to send in sicknotes anymore.

    When you call back ask if there is any notes about your group,
    If not, ask what your award rate is showing as
    72.40 = assessment rate
    101.15 = WRAG
    108.15 = SG
    123.70 = SG

    If you are still showing as on assement rate, ask them to look in 791 to see if there is a record of the recent decision.

    I imagine what has happened is that you did not score enough points so the DM used his discretion and awarded you
    Regulation 29 for WRAG
    or
    Regulation 35 for SG
