Hi, I wonder if someone could answer this query for me.
Worked full time for over 25yrs until 31 December 2012 paying full N.I. contributions during the whole of this time.
Received JSA (Cont based) Mar 2013 - Sept 2013
Worked p/t Sept 2013 - Jan 2014 (below threshold for N.I. deduction)
Signed on JSA Jan 2014 - July 2014 but was not eligible for JSA (cont based)
Started work Jul 2014 but due to illness only lasted 2 days
Claimed ESA Jul 2014 - Sept 2014 and was eligible for payment.
Transferred from ESA to JSA Sept 2014 as now fit for work.
My question is based on the above information will I be eligible for JSA payment as it is in a different tax year from when I last received payment.
N.B. I am not eligible for income based JSA due to son living at home.
Thank you

Having your son live at home does not make you ineligible for income based JSA. it is only a partner and their (plus your) income/savings that are taken into account.
Your son is a non dependent and would affect your Council Tax support and Housing Benefit/|Housing costs.
Have you a partner?0 -
No I have no partner but should have mentioned that I receive a small pension which doesn't even cover my mortgage. I know I am not eligible for the income based as last year I was already informed by DWP that when JSA (cont based) run's out that I was not eligible. I have no savings.0

The best thing you can do is just apply. Nothing to lose.
If your pension is your only source of income then also apply for council tax support although there will be a non dependent deduction because of your son.
Did they do a proper assessment for income based JSA taking into account your housing costs?0 -
The amount of pension disregard differs between JSA and ESA. For ESA the first £85 per week is disregarded plus half of anything over that figure. For example a pension of £185 per week - £85 disregarded and half of the remaining £100, so £50 per week would be taken off your benefit.0

For income based JSA and ESA an occupational pension is deducted £1 for every £1 form any awarded amount.
For contribution based JSA there is a £50 disregard and then it is deducted £1 for every £1.
For contribution based ESA there is a £85 disregard then 50% of the remainder is deducted.0 -
Thanks for doing that pmlindyloo. I should have made it clear I was talking about contribution based benefit.0

How much were you paid per week? Did you have your Pension income at the time?Received JSA (Cont based) Mar 2013 - Sept 2013Worked p/t Sept 2013 - Jan 2014 (below threshold for N.I. deduction)
Sounds like this was more than 12 weeks from date of previous claim, what date in January did you claim JSA from?Signed on JSA Jan 2014 - July 2014 but was not eligible for JSA (cont based)Started work Jul 2014 but due to illness only lasted 2 days
This does not make sense, that you were awarded ESA C in July but not JSA C in January, this would only make sense if you had claimed JSA C from 5th January or earlier. But had this been the case you should have been advised to withdraw your claim and claim from 06/01/14 or later. Or you did not get the pension income during the 2013 JSA claim ???Claimed ESA Jul 2014 - Sept 2014 and was eligible for payment.Transferred from ESA to JSA Sept 2014 as now fit for work.
The short answer is most definately yes you will qualify... But we need to know why you were disallowed JSA C in January first before we can actually be certain. My question is based on the above information will I be eligible for JSA payment as it is in a different tax year from when I last received payment.
This is not taken into account, How much pension do you get? Do you own other properties?N.B. I am not eligible for income based JSA due to son living at home.
You're WelcomeThank you
