USA Holiday with criminal record??

  • Exactly what I've told those members bagand96 funnily enough they asked not to be named because they didnt want to be flamed. But I messaged them and said knowing my luck I'd be the one who gets pulled aside. I have checked and all my convictions are spent including the cautions so it would be last year's incident of a caution for fraud. I emailed my solicitor who dealt with the case and she said that as it was a caution she didn't think it would effect my application and generally its just drugs they block applications for. When I did get the caution for fraud I told the police that I was under alot of pressure with my mother being ill and thus why I admitted it as it was no excuse so hopefully my honesty will go in my favour due to the mitigated circumstances and my honesty with the police last year.
    I'm hoping so anyway!
    So is the process no i tick yes to convictions on ESTA..get declined..then apply for a VISA? i'm Still struggling to find a digital picture store though as many want you to have a white background at home..but the 1st step of the VISA in the US is a digital pic must be uploaded..

    The ESTA is not relevant to you, so don't waste money on it.

    Don't waste money (and time) telephoning the US embassy since all that they will tell you is to apply for a visa, which is all that they tell anyone.

    If you get legal advice, it would have to be someone familiar with US Immigration policies rather than an English solicitor.

    I am fairly confident that your application would be declined, but hope that you will learn valuable lessons from the experience.
  • A different problem might be the caution for Insurance fraud. This might lead to travel insurance companies being unwilling to provide cover, or an excessively high quote.

    Just don't declare it. The U.S. government has no access to your criminal record. Just do esta and lie like everyone else!

    So am I to assume that following this extremely poor advice, you have sent the OP a message stating that in the event that they get chosen for a random check and the immigration officer suspects something isn't quite right and the OP's history comes to light, you will be more than willing to cover all of the financial costs incurred by them due to taking your "advice"?

    Dont be silly. Why would they admit to anything in a random check? " no officer, I have no criminal record and I am here for a holiday with my friends". Job done.

    They are good at lying and keeping a straight face

    They are also Irish and who knows maybe the CBP officer processing them was also Irish :p

    The OP sounds like he would be a nervous wreck which would attract suspicion from the "Behavior Detection Officers"
