Hi. I have just collected my car from a FREE park and ride car park attached to a tram station in Manchester I left it overnight as I had gone into town and had a pint. I returned on the last tram. What I didn't realise is there are signs saying you cannot park in there when trams aren't running. Why would I check for them its a free park and ride car park for tram users? My understanding is that I wait for a letter off parking care and appeal it via 1 of the letters in the newbies thread. There are signs in the car park and also cctv cameras. So I assume I am appealing it on the fact they have not suffered a £100/£60 loss. It does seem like a scam to try and catch you out if you use the car park for a night out as the ticket was issued in the early hours apparently. My car is a lease car I also assume I contact the company and tell them to pass on my details as the keeper of the car and not pay the fine.

as its a leased car then you do not want them chasing the RK at all
so you appeal it using the full template letter either now or at day 21 from the parking incident

Hi Redx yes it's care parking what are they like? So as I understand I just appeal against the ticket straight away.0

use the search box and search words such as care parking , metro , tram , manchester , anchor etc to find similar threads or issues
as its a hire or lease vehicle, you dont want the hire company involved at all, although you can still go ahead and inform them to pass anything onto you but that you are dealing with it yourself
under BVRLA guidelenes, the lease company should actually absolve themselves under POFA 2012 by naming the keeper (you) if any NTK arrives, but they usually charge you for this, hence why you want nothing going to them , so yes, appeal asap or at day 210 -

yes you are the keeper of the vehicle, the hire company are the RK or owner , I could have been the driver (but am not)0

Or appeal as driver which makes it certain the PPC cannot write to the lease firm. If it were me I would amend the usual template appeal in the Newbies thread to call your self the keeper and driver (remove the two sentences about not divulging the driver). Or write your own version - doesn't matter as you will win at POPLA stage anyway and the whole point is merely to get a POPLA code and to keep it away from the lease firm.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Morning guys.
Just had my rejection letter through after appealing with the template. Their reasoning is:
I agreed with the signs printed on the signs. Well there are none at the entrance only a big sign saying free to metrolink users. The signs are lilac lettering on a reflective background. Difficult to read during the day but at this time of night at this time of year virtually impossible especially when a light is put on them. I have been back and at exactly the same time taken pictures. Especially the signs overgrown by bushes and facing the wrong way.
Secondly it is for the use of tram users only and an operator observed the driver getting on a bus straight from the car park. I have the tram tickets I used and also paid for them by card so can also be shown on my bank statement that day. The time of purchase. So they now employ liars.
Thirdly the information I have used from "a forum" is outdated and inaccurate as I have based my argument on pre estimated loss and as have no access to this information I could not know and it is now private thanks to HHJ Maloney QC. Is this true
Fourthly unfair terms cannot be used as they were plain and intelligible. They maybe they are so difficult to read due to the colour used for the wording which is completely tactical as the big sign at the entrance to say its free. There are no T&C at the entrance.
Fifthly they say they do have legal standing to pursue charges on this land and have to file it every year for audit to DVLA.
Finally they state I filed my appeal outside the 14 day discount period. Complete nonsense again.
Any advice to what I can add to the template and may approach greatly appreciated.0 -

Find a POPLA appeal example from post #3 of the NEWBIES thread and proof read/adapt it to suit.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi. Yes I have a POPLA code and appealed as the keeper. I was just wondering whether they were talking nonsense with regards to what I appealed with being out of date. They have completely lied about the other points so I would assume they are talking nonsense now.0
