refunding lost parcel to avoid defect

Myhermes have refunded me for a lost parcel, can I just refund buyer via original paypal payment or will Ebay give me a defect. Buyer messaged me via messages and didn't open a case. I'm sure Ebays getting more confusing by the day!

Explain to the buyer that you're cancelling the sale, as you cannot replace the lost item & they need to select I agree to cancel on eBay

Just discovered I can't cancel the transaction as it's over 30 days old, purchased in August, reported lost 2 weeks later(!) and chased up with Myhermes (parcel showed delivered but buyer said not received, amazingly Myhermes agreed a refund). Guess my fees are lost but how do I avoid a defect. If I refund privately what's to stop buyer from then opening a case for lost mail and trying for a second refund via Ebay/Paypal? Problems with buyer from start so do not want to make any mistakes (actually asked advice on here in another thread about this buyer before I posted, my fears were confirmed when parcel went 'missing'). Maybe I should just refund and take a defect and get it over with!0

I'm intrigued as to why you didn't refund as soon as item was lost instead of making buyer wait for your refund? You were very lucky that buyer agreed and didn't hammer your stars.

Why didn't I refund buyer before hearing from Myhermes? because the item tracked as being delivered! Just checked help section on Ebay and it is 30 days for a cancellation, also says you cannot cancel if item has been posted.

Also eBay appear to say 60 days as well

If you trust your buyer, you could always just send them the full amount as a 'gift'.
You avoid a defect however you won't get your fee's back and the buyer could also open a PayPal case or chargeback within 180 days and you would have to cough up again.
Really depends how desperate you are to avoid a defect0 -
Hi, I certainly don't trust the buyer, as mentioned I've had problems from the beginning (I was advised on here to ignore him as item showed as delivered, but I gave him the benefit of the doubt and chased it up with courier who agreed to refund loss of parcel). I'm just going to refund and put up with the defect and loss of fees, although I did read an article earlier that said if I refunded less a penny it would not be classed as a full refund so no defect. Any ideas on that?
If I refund his original payment can he still open a case, although as courier shows as delivered I guess he'd lose it, guessing that's the reason he didn't open one in the first place.(we decided on here he was drop shipping).
Not really bothered about the defect, I already have a couple from Ebays stupid rules - refunded Belgian buyer who registered as UK buyer (actually relisted item so they could buy it again with correct address - didn't know I had to cancel prior to refund and did it wrong way round) and a where's my parcel case (purchased Saturday sent by courier and case opened on Monday!!)0
