If you both feel that the decision was wrong, you can appeal the decision. Ask for full written reasons, and make an appeal on form GL24, available from the Job Centre Plus. You have one month in which to get the appeal submitted to the DWP.

You'll need as much evidence as possible to challenge the decision, and medical evidence is very important. It's not the be-all and end-all, though, but if you appeal you have to show the tribunal that the decision was wrong.

You can get further advice on the appeal from CLS Direct, on 0845 345 4345, or try your local CAB if you want representation at any tribunal.

Go to the CAB who will refer you to a welfare rights worker, who will help you to appeal.

Just a thought but why not try & claim dla for your disabled brother? I too have sister who has downs but thankfully she is still quite able, albeit very slow. I dont know the degree of disability your brother has, cos people do vary in life. I have total sympathy for you & your family as i know how hard it is looking after a disabled child, & with a personal injury it must be twice as hard. Do take some of the advice given in the posts above, you really must appeal. All the best & try to post back if you have some more news. lexi.

If your mother is 60 or over, contact The Pension Service and they will visit her and assist in the application (they know how to get the information across). If she is over 65, then AA will be the one to claim.

Is your mother claiming any other benefits?
She may be entitled to other benefits even if DLA/AA refused.

Still submit the appeal as a late appeal. It still can be considered.
