If you just get statutory paternity leave it shouldn't be a problem. If you get enhanced paternity leave its worth checking your contract/t&cs.

You should be able to leave whenever you wish, subject to working your notice period or forfeiting your salary for the period of notice you should give if you fail to work it.
I am employed as a manager in a financial services institution. My views are entirely my own.
  • i get 2 weeks ordinary paternity pay but enhanced so that i receive my full pay while im off. ill have to do some digging on the company website.
thank you for the fast responce

My husband took his paternity leave with full pay as the last two weeks of his notice and then moved straight to another job instead of going back. If on enhanced pay though your employer may have rules about going back just as many do for maternity pay. Mind you this was 4 years ago now.
  • Hi I would be interested to know if anyone has left straight after additional paternity leave and was there a period you had to work after returning? I would think that as its effectively unpaid by your company it shouldn`t be but has anyone done this? Thanks :)

If you are only being paid statutory paternity pay, then no, you don't have to return at the end of your APL. If you are given contractual paternity pay (ie more than statutory), then if you don't return you may have to repay it. Also, remember that you will continue to accrue annual leave while on APL, and if you don't return to work you must be paid for this.
