PPI Reclaiming

I had a Career Development Loan with Barclays in 2000, which was paid off in 2005 or 2006. Unfortunately I don't have the details of the loan. I have written to Barclays requesting the Loan Agreement under the Data Protection Act but have received a letter back stating that they no longer hold a copy of these documents.
I am sure that there is PPI on this loan. Do I write to the Financial Ombudsman or is there another way to get hold of the loan agreement?

Loan agreements are only available under the Consumer Credit Act (not the DPA) for open accounts still being paid. You will never receive the Agreement from anywhere if your account is closed. You have therefore wasted your time requesting this.

You don't need the Agreement to make a PPI complaint, what you need are valid and (preferably) verifiable mis-selling complaint reasons. Have you thought of simply asking Barclays if PPI was applied to your loan?
  • Thanks for quick reply. I have written to them in the past but never received a response. I will write again but wanted the actual loan agreement reference.

If you want a formal response in writing then you'll need to send them a Subject Access Request (SAR) letter which costs £10.

Why you don't simply ask them if if there was PPI is beyond me. If you ring them, you'll have an immediate response and can act accordingly.

You dont have access to the FOS yet as you havent made your complaint.

If it doesnt exist at the lender then they can use your copy if you have it.

The agreement is not required to make the complaint. However, the FOS cannot get involved until you make a complaint. You havent done that yet.
