Hi guys,
This is a more happy thread in relation to 3 defaults that i had on my account which was taken over by Lowell
Lowell Portfolio - £504
Lowell Portfolio - £541
Lowell Portfolio - £816
I phoned up in relation to these accounts today and managed to get all the dates in regards to the account. After they provided all the information all debts where found to be Statute Barred.
What they did was apply a default in 2009 and informed that the clock for the Statute Barred. Starts from the day of the default and not the date of the last payment or writing.
I managed to speak to a senior manager at Lowell who tried to get me to agree it would start from the date of the default. But when i provided case law that the default is not a "cause of action" and provided 2 cases where this was ruled.
She very quickly apologized to me and informed me that the 3 accounts would be closed and defaults removed. She will also be sending out letters to confirm this in writing to me.
I am now working on my other defaults as some of them have been applied after 1 year. And in one case a default was not applied until after 2 years.
So today a total of £1861 has been cleared from my credit files
going to keep chugging along and get my files cleaned up
