enquiry -land registry restriction process

We would like to lodge the following information with the Land registry re...
A) Consensual Severance of my and my husband’s house ownership ,from Joint Tenants to Tenants in Common and
a restriction re the relating declaration of trust to leave my part of the property to my son and my husbands to myself and if not my son (his step son) ( we understand the Land Registry do not record deeds of trust, all they do is register restrictions )
We have severed the the tenancy from joint tenants to tenants in common , created declaration of trust and wills , we have split the property ( uneven % ownership ) but are a bit confused re what do submit to the land registry as we want to ensure we understand with regards a financial and beneficial perspective how it affects your estate etc when one of us passes away
We believe that we need to use ...
A)The ‘ SEV’ form (re the severance) -joint application , no fee , no other docs required
B )The ‘ RX1 ‘ form (to lodge a Form A restriction re the deed of trust) -fee £40, joint application, submit a copy of declaration and not the original & ensure we put on the top of the copy declaration " We hereby certify that that is a true copy of the original document" and all interested parties initial this

You dont need both SEV and RX1 to register a Form A Restriction - one or the other and there is no fee. SEV form is specifically designed for when joint proprietors want to register by mutual agreement.“Official Company Representative
