Divorce costs

Hypothetical question but if someone is married and they want a divorce (just drifted apart etc no-one to blame) how much on average is a divorce? And how long does it take?

    the current cost is £410, but there are fee remissions available if you are on a passported benefit such as income support or income based JSA/ESA.

    Just to add that "drifting apart" isn't something you can rely on in support of a divorce. There is only one ground for divorce: that the marriage has irretrievably broken down.

    You then have to demonstrate this irretrievable breakdown has been caused by one of five facts: adultery and you find the other person intolerable to live with (this element does not have to be related to the adultery) , the behaviour of the other party and it would be unreasonable to expect you to continue to live with them, that the other party has deserted you, two years separation with the other party consenting to divorce, or five years separation without their consent.

    £410 is court costs, unless one alleges unreasonable behaviour or adultary etc then you cannot file for divorce until you have been separated for 2 years.

    Once filed you will have to wait for papers to be served on the other side, for them to respond and then for it to get to the front of the queue. You then get a the Decree Nisi and have to wait 6 weeks before filing for the Decree Absolute.

    Total time depends on how quickly people respond and what the backlog in your chosen court is like. 3 months from being able to file is an optimistic answer, up to 5 months is possibly more realistic. Obv thats ontop of the waiting 2 years if it is just a case of drifting apart.
