I am not entitled to ESA what can I do??

Hello All, I need some advice. I received a letter a few days ago stating I was not entitled to ESA.This was because I was found capable of work during my WCA back in May.

Now, I appealed that decision and I have a tribunal in the future. And, I also asked for a Mandatory reconsideration. Which I scored more points but still wasn't quite enough to be awarded ESA.

My question is what do I do now? Go back to JSA? Asked for a yet another Mandatory reconsideration? Wait until my tribunal is over? God forbid I lose the tribunal then apply for ESA?

Just out of curiosity is it 6 months from the WCA you have to wait to claim ESA again? Anyway, Interested to hear your thoughts and opinions on what I should do. Thanks

    Are you fit for any work? As the MR was unsuccessful you can now claim the assessment rate until your appeal is heard.

    You have to send in sick notes to claim the assessment rate of ESA until the appeal is heard.

    Have looked at your previous threads.

    Did you apply for JSA whilst you were waiting for the results of your reconsideration?

    When you had the results of your reconsideration did you tell Job Centre Plus that you wanted to go back onto ESA whilst you were waiting for the appeal to be heard?

    If you have appealed, to the the court tribunal service you would have a letter from the court confirming that you have appealed.

    You need to phone ESA and ask them if they have received a notice from the court that you have appealed.

    If they have not, ask for an appointment at jobcentre to have your appeal court letter faxed to the ESA BC.

    If they have, ask ESA to reopen your ESA claim on appeal ....You will need a sicknote from the date your last sicknote with ESA ran out. and send it to ESA, And ask JSA to close the JSA claim (if you have an existing JSA claim).

    You will be paid on ESA on appeal, unless you have not told us something important, like ESA Conts and you already had it for a full 365days.
