Parking eye county court claim fine - what to do?

Hi,

I was notified by Parking Eye that I had parked in one of their car parks and they sent a fine letter out in the post last month.

There has since been a further two letters and the most recent letter is threatening court proceedings in the next 14 days.

Can anybody advise me on this, I thought that these were just threats in the letters and they would leave when I didn't send payment.

    You have let this escalate and earlier could have been nipped in the bud
    Most likely too late for POPLA (check dates), but still you are going to ask the courts to direct PE to give you a code
    Its either pay a reduced offering or fight, because they are not going to give up easily





    When can you appeal to POPLA?

    You may only appeal to POPLA after you have made your case (‘representations’) to the operator who issued the parking charge notice and that operator has rejected these and issued a POPLA appeal form.

    For more details on what to do when you receive a parking charge notice, see our section on this website.

    A verification code will be sent by the operator with the rejection of your representations. You will need the verification code to appeal online. If you were not sent this, the operator should be contacted to obtain one. You must appeal to POPLA within the 28 days.

    If your appeal is late, it cannot normally be considered. If you do send it late you must explain fully and clearly on the appeal form itself why it is late. The Assessor will then decide whether the appeal can be considered but this is likely to happen only in very limited circumstances.

    If you do not appeal at this stage the operator could seek to enforce the parking charge through the county court.

    No idea why you thought you could still ignore this when this forum hasn't advised that for nearly 2 years now, since PE started suing people around the same time we found how to win EVERY time on appeal.

    Why don't you just respond as per the 'LBCCC Fightback' thread seeing as you have a LBCCC? It's one of the sticky threads you really should have read first, along with the NEWBIES thread, which tells you how to claw this back to appeal by NAMING THE DRIVER (name and address of the person who the keeper thinks maybe...when they think hard...was driving that day...).

    DON'T SAY YOU CANNOT NAME THE DRIVER - YES YOU CAN!

    Yes - this is covered in the newbies thread - please read the link where I talk about rewinding the clock. OF COURSE you have to give the address to open up the appeal possibility so PE can send them a postal PCN, starting from scratch so you can win as a family by the driver appealing.

    You know it makes sense. Don't say you can't. Don't say here who may have been driving...don't say anything about the address HERE. You do realise an 'address for service' of a PCN can be ANY address where the driver can be 'reached'? NOT where they live if you'd rather not. How about a work addy? An Auntie's house? A neighbour or friend who will hand the driver the PCN as soon as it arrives?
