    Probably but it's kind of a 'so what' moment. Things are also changing in consumer law including ADR having to be offered for a year, soon. Also these so-called 'consideration/contract' PPCs are merely breaching existing unfair terms regs (i.e. it's just a disguised penalty). Add to that, the publicity of the Beavis case if it goes the right way in 2015, it could all come together shortly and the scam could be much more well known with people suing landowners & retailers to reclaim losses.

    That's what the PPCs are dreading I expect. Beavis is certainly making them twitch.

    However if VCS gets the NTK right and served in time then it renders that point redundant.

    Arguing the point that keeper liability doesn't exist at the JLA may hold have some argument but I wouldn't hold your breath with IPC.

    Ignoring might be the better option at JLA and their other airports. I'd love to see them take one of these to court.

    I may be very wrong but... would the 'contractural charge' issue result in a change to the business rates for the car parks etc?

    For a previously free car park a change to a 'contractural charge' is a clear indication that the car park is now intended to be generating revenue, so could this affect the rateable value therefore business rates must be reassessed?.

    How many of the VCS/NTC/G24 landowners will want this?

    And not forgetting the VAT implications.

    IPC will merely be the PPCs answer to GPEOL. It will cease to be a valid appeal point with the 'assessors' totally accepting the scammers financial breakdowns. As small a ripple in the pond as it was, GPEOL caused at least every win to feel like a small celebration.

    I have advocated motorists including asking for a VAT invoice with their initial appeal. This is to flush out whether the charge is a parking charge or a charge for breach.

    Even with IPC, GPEOL is a valid appeal point for a breach.
  • I am currently appealing to a VCS parking charge at Robin Hood Airport using Coupon-Mad's template letter (thanks). Had a rejection from VCS stating I do not have grounds and have to appeal to IPC. doesn't seem as straight forward as POPLA. Wondering whether to ignore replying/appealing as they do not have grounds under POFA 2012 as I am only the keeper and not the driver (which I wasn't). Any help would be appreciated, then i will post in relevant thread. Thanks

    You need to start your own thread after reading other VCS 'IAS threads'. This thread isn't one and is not really the place to post such a query - you should read threads about writing an IAS appeal or not bothering, which normally depends upon the signage.
