Just been notified of pending redundancy help please

I'm a sales rep paid on a basic & commission basis, plus a company car is provided for work & private use.


1) I have been given a settlement figure, which is written using the words 'you will be entitled to receive notice of termination of £XXXX , in accordance with your terms and conditions of employment, and a redundancy payment of £XXXX'


I have no idea what notice of termination is or how they have calculated it, can anyone help?


2) Under the government rules it states 'For a redundancy to be genuine, you must demonstrate that the employee’s job will no longer exist.' I have been told that the reason for redundancy is that the territory does not justify an external sales person and that the MD or SD can handle the accounts and territory I cover with office based assistance. Does that demonstrate that the employee’s job will no longer exist?



3) My company car is part of my package, can they swop it for another of poorer quantity during the notice period?

    1. - notice of termination would be the 3 months or 1 months notice you are entitled to in your contract plus any accrued holiday if you aren't going to be allowed to take it.
    2. In principle yes that could demonstrate that there isn't a role - remember its not you as a person that is redundant its the role which in this case would appear to be that they don't need as many sales people as before. However it may not be the case that just because your "patch" doesn't need a sales person you are the one that gets made redundant. It may (note may - you need advice on this) be the case that all sales persons should be considered together against fair criteria and the lowest graded one is redundant with you potentially getting a different area. That may not suit you if it meant much longer travel etc so worth considering carefully.
    3 - ordinarily no.

    If they give you paid notice and do not require you to work (garden leave) then you may be required to surrender the vehicle at the end of your active work. They are unlikely to downgrade it if they want you to work your notice period.
    Some days, it's just not worth chewing through the leather straps....
