    I have received POPLA decision email, which "Allows the appeal" based on "Parking charge amount is not a genuine pre-estimate of loss".


    Though no correspondence from Highview yet.


    My question here is, what should be my next step here?
  • Great news on the appeal.

    Your next step is shout it from the rooftops - bang in a complaint to the landowner that Highview are wrongfully stinging the car park users and should be booted off site.

    Nothing - you win! The charge must now be cancelled as the decision tells you. Please post about your success in 'POPLA Decisions' near the top of this forum, stating which PPC and copying & pasting the decision & POPLA Assessor (minus your car reg & name of course). It is over, you won!

    I see Highview have mentioned the "average spend" in their submission. But surely that means if there has been any "loss" (and that's very doubtful) that loss has been suffered by the shop and not by the PPC. Do Highview pay the shop to compensate for this supposed "loss". I very much doubt it.
    What part of "A whop bop-a-lu a whop bam boo" don't you understand?

    The POPLA assessor raised the question of that average spend figure. Did the PPC consult the five stores in the shopping centre to get their turnover and the customer footfall? even if they did, any mythical loss would only occur if every car park space was occupied and a potential customer was unable to park.

    And who is to say that if an average customer spends, say £50 in an hour, that an overstayer who parks for an extra 30 minutes doesn't then spend another £25? It's a daft argument to assume someone who shops for longer doesn't spend more. I am a woman and I know I spend more, the longer I shop!
