Capital one wants old info I don't have!

Trying to claim for PPI missold by Capital One as self employed 10 years ago but I do not have any accounts info or proof I was self employed the year I applied. I ticked that I was self employed on the application form originally which they have sent me a copy. I can not get proof from the Tax office as records do not go back this far. Capital One say they will close my PPI request if I can not show proof. I do have proof for all the years after which I have still been paying the PPI just not the year in question. Do I give up? Any advice much appreciated, I am new to all this. Thanks :)

The problem is that it's the point of sale that matters, not what happened later. Did you get someone to do your accounts? Could they help?

If you don't have the proof, unfortunately the complaint falls down - burden of proof is on the accuser. Don't forget also that some PPI covers self employed so it may not have been a miss-sale purely on that point, if it covered self employment without particularly onerous conditions

Sam Vimes' Boots Theory of Socioeconomic Unfairness:

People are rich because they spend less money. A poor man buys $10 boots that last a season or two before he's walking in wet shoes and has to buy another pair. A rich man buys $50 boots that are made better and give him 10 years of dry feet. The poor man has spent $100 over those 10 years and still has wet feet.

  • It does seem a little unreasonable of them to be acting like this when the information they are asking for relates to a date so long ago. Especially when the card application they have indicates that you were self employed.

If they haven't already, let them issue their final response and send the complaint to the FOS.
