PPS Appeal Success!

Thanks for all the advice! My PCN was issued in the PPS carpark opposite Didcot Station on 16/9/14. I sent the template letter, changed a little (see below) on 18/9/14 and received a reply dated 26/9/14: "Having considered the content of your letter we are prepared on this occasion, as a goodwill gesture, to cancel this parking charge notice."

YIPPEE :j I got this ticket after stressful day travelling to see oncologists at Barts Hospital, I'm thrilled not to have to shell out £100!

Here's the letter I sent:

Dear Sir

I refer to the above notice which I appeal against, as keeper of the car, on the following grounds:

a). The sum sought does not represent a genuine pre-estimate of yours or your principal's loss.
b). The signage on site is deficient and fails to comply with the British Parking Association's Code of Practice, Annexe B.
c). In the absence of any evidence it is my case that you lack any or sufficient proprietary interest in the land.
d). Your notice was deficient and fails to comply with Schedule 4, Protection of Freedoms Act.

I fail to see how you can justify a charge for being out of a bay when no one else has been prevented from parking. This charge is therefore punative and non-enforceable. Please supply a full breakdown of how the £100 charge is made up if you allege it is directly caused by this parking event.

Please uphold this appeal or send a rejection letter so I can escalate this matter to the independent service offered by your Trade Body.

    That would seem to be the final nail in the coffin for PPS' fictitious GPEOL schedule that lots of the other PPC's copied when PPS got a couple of lucky wins at PoPLA. So dead in the water is it they're not even bothering with PoPLA now!

    Yay - PPS are defeated then, if they cannot face POPLA when they see that appeal. Their made-up 'GPEOL' sums didn't last long!
