Section 75 CCA Claim

I just wanted some advice really,


I took iPad's into a repair shop local to me to get new screens (they had cracked).


They quoted me £70 for each to be repaired, I haggled and they agreed a deal of £130 for the pair to be done.


I left them with them and returned the following day to collect, I purposefully paid on my Barclays Credit Card, as I hadn't used these people before and wanted some protection.


I noticed when I got them home that one of them hadn't been fitted correct and the home button didn't click properly and the second one had smears and dirt underneath the new glass !


I therefore rang back the following day and they said no problems bring them back in again, I took them in and they said they would obviously sort them out free of charge.


I left them with them again, and collected the following day. they seemed fine, then I noticed that the first one, although the home button was working fine, it hadn't been stuck down properly at the bottom! it didn't affect it working, and it was a friends child's iPad, so they accepted it as it was.

The second iPad seemed fine, I didn't use it for a couple of week as I was a birthday present for me partner. When I gave it to him all seemed fine, then we noticed that there was dead spots on the screen in places, and also when putting a sim card in it, it wouldn't get a signal on any network !


As id had so many issues I rang Barclays and disputed the payment, as they hadn't repaired them properly, dispute being back twice.


They processed this and said they have 45 days to respond.


In the meantime I have taken my iPad back into the shop to get the screen sorted for the 3rd time and the Sim Card signal issue sorted.


They said they would look at it, but they noted that it had a dent in the bottom right hand corner, and had been dropped since the second repair! I disputed this and said that I have photograph proof that the dent had been there all along!


They then opened it up and called me to say that they had found the issue and ordered the part. I said that was good news, but what caused it? and they confirmed it was something they did, not anything I could have done !


This was a couple of days ago now, and im waiting to collect again. SO really my question is whether you feel my claim will be accepted? I understand that as its 2 separate items it doesn't technically come under the £100 lower limit, but as they did them both for a set price, and both have had issues that it would come under the Section 75?.


Im just getting really concerned that im going to end up £130 down and without a working iPad !


All the credit card company wanted to know, was if I had given them an opportunity to repair, which I clearly have.

    So you've raised a Section 75 claim and then taken the iPad back to the shop to correct the repair?

    Wanting to have your cake and eat it comes to mind!

    Yes, only because I wanted them to be aware that I am disputing it. Plus considering what has happened I don't have a lot of confidence that it will be right this time.


    I have informed Barclaycard that I have taken it back too, which they didn't have a problem with.


    If they do repair it properly, then the shop will contest the claim and say so and I will agree, if all is ok. SO I don't see a problem with what I've done.

    I would let Barclays know, if your not careful this could be seen as fraud.
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

    Yes I know, I have said to Barclays all the time 100% that I took it back. I also rang them to tell them that the shop "suggested" that I had dropped the device, and they updated there notes to that affect.


    They didn't care about that, as they are jointly responsible. I was just disputing the work that was carried out in the proper way.


    If the device is repaired satisfactorily then I will tell Barclays that. If not then I shall let the claim continue.

    You cannot make the Section 75 claim AND have the repairs corrected by the shop. It's either or.


    I appreciate that hindsight is always 20/20 but the lesson here is to take them to an Apple store for repair if you want to be sure than it is done correctly.

    Im not intending to have both! I have logged the dispute straight away, as im not happy that its the third time I've been back!


    As I've said, if the repair is successful then I will let Barclays know, if not then I will continue the claim. I just wanted to let Barclays know at the first opportunity that I was in dispute over it.


    I normally would, but Apple wanted £250 per device to sort it out, and I couldn't afford that.
