the other bitter pill you will now have to swallow is that it is perfectly possible to do all this court stuff yourself to get your tenants out - if you join the NLA and read up, do some research, fill in the forms carefully - you can do it yourself. your solicitor will charge you an arm and a leg.... m mm is this the business for you ?0

According to this, that is harassment.
According to this harassment is illegal eviction that can result in a fine of up to £5,000, 6 months in prison and unlimited civil damages being awarded against you.
Be careful of following advice on internet forums!
Having said that, I know a LL that paid a bunch of builders with a few cases of beer to hold a kanga drill up to a squatter's throat to encourage him to leave. Very effective. Almost certainly illegal but as it was never tested in court, who's to say whether it was legal or not.0 -
I have a tenant that owes 7 months rent to date. I've instructed my solicitor to start proceedings to recover the debt and eviction.
From experience, on average, how succesful do you think I will be when trying in acheiving the above processes?
How long will it take before property is recovered?
Will it be easier for a local agent to look after the property during this process because I live some distance away from the property?
Sorry to hear this, this is something that you will learn and will make you a better person in the future. You learning by this may help people you know in the future.
I hope that you can afford to live and have the house empty, if you have been living ok then maybe i would look at just getting them out of the house without it being damaged, you have to work out if you want the 7months rent in small payments & the house smashed up needing repairs, or you write it off and get the house in a state where it need a days work cleaning it up and painting it to enable it to be let again.
Im sure you have a deposit on the house, you could maybe hold this back from them telling them if they move out sucessfully and take all there stuff with them then they may get it back to a certain extent.
This may sound madness, but i know of people who have been in the process of moving out, found out they were not getting the £500 deposit back then decided to punch random holes in walls and ceilings, when questioned claimed it was not them and proceeded to move out and that was it. The people in question were in and out of work, claiming job seekers allowance etc. There was dog poo on the carpits, unwashed pots, poo on the toilet walls etc.
I would see it as 2 options..
1) You proceed with the recovery of the rent through the courts, they eventually move out in a bitter mood not taking care of the house in the process, therefore marks, dents on walls etc.
2) You tell them you want to forget the rent, you are willing to give them a partial refund of the deposit as a 'good will' jesture subject that they move out within 'X' amount of days, and that the property is returned as close to the standard that it was let as possible (ie all personal remains removed, cleaned etc).
I think you get the house back, you get it back faster, cleaner, with the opportunity to get it back on the market within a week.. therefore income in your pocket sooner, than later.

Though i think the reality is that they wont move out, and you will be left with evicting them so they go into local housing association, lose the deposit and it will be a few more weeks of not being paid.

This will depend on how your solicitor deals with the case, what he advises and what actions you take.
if you live a distance away, then it would be good to get agents to manage it,
Here's why: If there is a problem the tenant has (pipe leaking, electricity goes off etc), you will have to rush the distance to go and sort it, so it is hassle, whereas if you let the agent do it, they can make your life easier and deal with any tenant problems.0 -
like Alias Omega - i have also paid tenants to leave - on the condition that they leave the house in a perfect state - its hard to swallow at the time - but its cheaper in the long run0

As above, it depends if you want the house in a rentable condition, or if you want to spend about £1500 getting holes plastered, carpets fitted, walls painted etc.
The sooner they are out, the sooner you get the cash in to pay the mortgage on this thing.0 -
I can't see any indication of what the tenant is saying. After 7 months of no rent, they surely would have some sort of story, even if it's BS. What are they saying?0
