i ordered a an electrical item worth £300 online it arrived and didn't work, i sent it back and asked for a refund, a week later i received an email saying replacement been sent not what i wanted.
i emailed saying i wanted a refund they apologized said i would have to refuse delivery.
Today i received a parcel too small to be original item it was a smaller electrical item worth £200 from same company i didn't refuse delivery as it clearly wasn't expected item.
It was delivered by royal mail tracked but no signature required.
Can i keep it and tell company i havent received original item?
i paid by credit card so can make a section 75 claim if needed.
i know this isn't completely honest but im fed up with company wasting my time waiting for couriers plus they have had my money for 3 weeks now.

You're going to get slated for the phrase "i know this isn't completely honest" on here. It's not 'not completely honest', it's fraud. Plain and simple.0 -
Nothing like wanting to keep an item, whilst using your credit card to claim back money....0

The phrase you are looking for is:smithers1981 wrote: »i know this isn't completely honest..."I know this is completely dishonest..."
Are you really expecting someone here to tell you "yes, that's ok"?0 -
Now come on Wealdroam the OP gives money to charity, looks after dear old mum and dad and goes to church every Sunday. I think we need to cut a bit of slack here and say "yes it is OK for you to do that".;0) Mind you once the company checks and finds that the item was delivered an has the OP summoned to go to court because of theft the OP can show these replies and state "well they said I could do it"
I do not know where these people get the idea that it is OK to fleece others just because they feel hard done by. Perhaps the next time the OP thinks about asking such a stupid question they may stop and think just what they are asking and put themselves in the companies position and see how they would respond then0 -
Hands up I'm clearly in the wrong will contact company arrange for them to collect item. Always think of the bank error in your favour from monopoly......0

Thank you
You seem now to have seen sense, do not get me wrong I can imagine just how frustrating your situation must be and "getting back" at them is IMO your way of squaring the circle but I think you knew even before you posted what replies you were likely to get.
By all means make it as hard as you like to get them to collect it {ie only on a Sunday night between 9.30 to 9.45}but I hope you will sleep better knowing you are doing the right thing

Unfortunately in life we play by a different set of rules. All of my bank account T&C's have contained a clause allowing them to reclaim monies paid in error. You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0
