Parking eye fine.. Faulty machine.

HI all,

I need some advice. (or course )
Whilst on holiday in Cornwall I attempted to park in a PARKING EYE controlled site situated on tower Road in Newquay. I parked up in an almost empty car park. 150 odd spaces. 10 cars present.
I walked to the machine entered my number plate and popped in a £2 coin. It would not accept my details.
I attempted roughly 5 times. Having to cancel each time and receive my £2 back. I decided to put more money in hoping this would remedy the issue. The machine still would not accept my number plate. But this time upon cancelling the transaction…… ate the £2.. and returned only the £1 I have entered afterwards.

I hoped that the £2 was registered in the machine as this was the last of my change. I attempted another couple of times before the machine consumed the £1 also. Leaving me with no change at all.

I then attempted to call the number on the signage, Only to be met with AUTOMATED FINE PAYMENT.
I had to leave the carpark after 12 minutes of payment attempts.

I bought 2 ice creams from a local shop with the last note I had to give me some change, and successfully parked in an immediately adjacent car park (also a PARKING EYE and also on Tower road) for the princely sum for £4.60
This carpark was only separated from the previous by a small wall. The machines could not of had more than 50 yards between them. But they were of a different design.

3 weeks later I received the fine… for the 12 mins in the first carpark.
I immediately went onto their site and entered an appeal. Attaching a pic of the ticket I purchased for £4.60. explaining the faulty machine.

I’ve now received a letter basically saying. “Produce a ticket for the 12 mins.. or else.”
Normally I would of just bowed down to the bullies as I’m kinda lazy. But this has made me angry.. Their faulty machine would not produce the evidence they request. Even though I fed it cash..

As a side note there was still 20 mins left on the ticket I successfully purchased.

I’m not sure what my next step should be. I may sent a letter registered post explaining again the situation.
But I will not send them the ticket for £4.60 as I think this may DISSAPPEAR…

What do you good people think?

    We think if you have a POPLA code now is the time to crush this at POPLA! See the examples in 'How to win at POPLA' in post #3 of the 'Newbies please read these FAQs first!' sticky thread near the top of this parking forum. It is irrelevant to POPLA that you went elsewhere so there will be no need to show them the £4.60 ticket. You will win using our wording which you will notice doesn't talk about what happened.

    I guess you have already made the rookie mistake of naming yourself as the driver which has thrown away a perfectly good slam-dunk winning appeal point 'no keeper liability' due to errors on the postal PCN. Never mind, you will win on other grounds because PE never contest our forum POPLA appeals.

    If unsure show us the draft you adapt from those you will find in the Newbies thread post #3.

    Report the matter to your local Trading Standards Officer,
    You never know how far you can go until you go too far.
  • Interestingly my cousin and his girlfriend just had the same issue on the same car park, see 'Complicated parking ticket situation' posted a couple of minutes ago. Maybe a joint appeal is in order?

    No do not do a joint appeal. You must appeal each PCN separately following the advice in the newbie thread. Otherwise you will end up with problems later.

    Besides for each PCN they take to POPLA (and lose because they will if you use a good appeal) costs them £27 + vat!
