replacement vacuum now broke too

My vax vacuum broke so they sent a replacement, now this one has done the same and only lasted 7 months but they said I'm NOT entitled to a replacement as it was under the original guarantee for the first vacuum even though I guaranteed this separate.... surely each individual is guaranteed the two years and I should get a replacement??? I'm not using it too much, just normal usage..... any ideas please???? Trading standards not answering yet but I'm keeping on trying... thanks

  • As a guarantee is not a legal right, simply something that manufacturers are free to offer if they wish, they are legally entitled to state how long the guarantee is valid for and if it covers replacement goods.

    It's pretty standard that a guarantee only runs from the date the original item was purchased and not for it to be extended to cover a replaced item.

    How long ago did you buy the Vax? and who did you buy it from?

    No point in bothering TS, the original warranty is all that counts so if you're now past the two years then it's run out. Your recourse now is through the Sale Of Goods Act, but you will need to provide independent evidence that the fault was inherent and not caused by anything you've done. If you can prove that to the retailer then they have to either replace, repair or refund, but if they refund they can retain a percentage for the use you've already had.

    i did manage to get through to ts and they more or less said the same, thinking about it, ive had my moneys worth really anyhow as i had about 10 months on the old one and 7 months on this one so ive gone out and bought a new one, will register the guarantee just incase lol....... thanks for your replys guys.... :beer:
