PCM Parking Control Management Ltd

[FONT=&quot]Hi - I have received a letter from PCM Parking Control Management Ltd to pay for a PCN. Parked without clearly displaying a valid PCM UK LTD Permit.

They have taken pictures of the car and it is available on their website (quite a few actually, including interior pictures, maybe trying to see if any letters or details are left on seat or something).

I did not pay the original windscreen ticket on the vehicle. About 5 times it was placed on s[FONT=&quot]ep[FONT=&quot]a
rate occasion[FONT=&quot]s [/FONT][/FONT]on my car but this time a letter has arrived. I was instructed by the landlord of the property to ignore them as he as been doing for a number of years now (or so he says).

  • Surely the Landlord employed them so he can get rid of them. Just tell the ppc to justify the charge down to the very last penny and ask for a copy of the contract

    No, the landlord hasn't engaged these cowboys, the management company has.

    Get on with the appeal letter.

    What does your lease/tenancy agreement state about parking and/or permits?

  • [FONT=&quot]The tenancy agreement does not include any indication of parking. Although this is not a matter of housing estate parking, but rather office / back of shops store room loading space with ample space for 20+ cars to park. [/FONT]

    [FONT=&quot]There is no bays, or lines to park within, no pay meter, no barrier blocking in and out path. Just signage in two places.[/FONT]
    [FONT=&quot]On many occasions the signage the company use has been ripped down and there is no signage. On other walls there seems to be other companies who probably patrolled the area before.[/FONT]

    [FONT=&quot]PCM’s permit is a printed out sort of permit, with some kind of code on it. Home made to say the least.

    There is a woman, who come[FONT=&quot]s[/FONT] around probably once a week or so, patrolling the space like a traffic warden. After getting into a verbal argument with her about not touching the vehicle she repeated 'it is their space'. The company (PCM) own the land or some nonsense. She could not provide me any info about the company or owner, nor did she know anything about the company. Just kept pointing to the wall. Pointless really for even arguing with her but whatever.     No-one is suggesting you pay, but the appeal isn't the easiest (maybe) because the 'IAS' is a lottery. It is not a fine but it is PCM who are an IPC member so the appeal is harder to win - unless PCM have used old signs (BPA version rather than IPC version, have a look?). It will also be winnable at the IAS appeal if you say you were not the driver who parked the car and are only the keeper, and if the Notice to Keeper can be shown to be non-compliant with the POFA 2012 paragraph 8 of Schedule 4. That Act is linked in the newbies thread and is actually really EASY to compare a Notice to keeper letter to, now you know it's paragraph 8 you need to check. Dates are worth checking and EVERY word including on the back.

    Show us the signs please, whether BPA or IPC (readable wording) and a pic of the entrance if no signs there, and a pic of any obscured signs like behind a tree branch or in the dark corner of a wall under a gutter, that sort of thing can win an appeal.

    Also show us the PCN (both sides, every word except your name/address.car reg/PCN number).

    Placing a sign on a wall sideways on, round the back by the bins, suggests it's merely a notice about residents putting stuff in the rubbish bins/recycling:

    The PPC goon took a nice pic of your car seat to try to prove no permit but in fact it helps show the car park in the background without a lot of signs at all:

    So I will give you a clue as to one flaw (one of a few which are only open to a keeper to argue, so DO NOT state nor imply who was driving) with that NTK letter even though I haven't seen the other side yet:

    DATES!! Check Schedule 4 as to the prescribed dates. One of them is wrong.
