Summons threat 2 years later

Hi – can somebody please advise me. I got a private parking ticket in October 2012. I had bought a ticket, but put it upside down on the dashboard. At the time I came to this forum and all the advice was to simply ignore it, which I did. I got one threatening letter from Court Proceedings Ltd in Dec 12 which I also ignored. I heard nothing after that and assumed it was finished.
Then last week I got a letter from another solicitors wanting nearly £300 within 14 days and threatening court action. I see on this site that all the advice has changed since I was last here, and I shouldn’t have ignored it. So what should I do now? I appreciate there’s a chance it will go no further, but what’s the situation now. Are they taking more to court and winning because no appeal was lodged, should I be making a very late attempt to appeal, is two years too long for them to even be chasing this up??
Any advice would be gratefully received. Fortunately I still have the original documents and ticket.

  • Having done more reading - I can guess the reply I'll get. I'll do a search on Miah then...;)
  • yeah, its actually good advice mate. the thing is to not to panic, spend a couple of days reading then it all seems a lot clearer. let us know how you get on.
  • Thanks ChesterD. Got to admit I'm struggling to find this Blissikins letter. I see you found it and seems we're in a similar situation - please can you give me a clue what thread it's under?
  • just search forum for Blissikins, then click on the name and look at threads started by Blissikins. easy from there

If you go back a page and click on search this forum, there is an option for an advanced search. Do this and then do a search by username, blissikins. It brings up her/his short and very useful thread.

So, you bought s ticket and placed it upside down and now they want £300, why?

My inclination would be pull out all stops and try to bring this one man band solicitor and his undischarged bankrupt sidekick down.

Get all the dirt you can on these scammers and send it to the SRA, Trading Standards, CA. the Chamber of Commerce, all the other solicitors in town, the local radio station, and the local paper. Make life difficult for them.
You never know how far you can go until you go too far.
  • what reason did it give on the original PCN?
  • original PCN had a tick against "without a valid permit or authority" and then scribbled next to it they wrote "upside down".
Does seem they'll have difficulty claiming £300 for loss when I paid for a ticket in the first place, but regret not appealing now.

I've read through the stickies and Bissikins letter but am thinking of paying £16 to parking ticket appeals, as I think they may do a better job of arguing the case than I can...
  • Doesn't sound like much of a case to answer to me. They've basically agreed that they knew you paid the correct fee & displayed the relevant ticket. Should be a pretty easy one to win in my eyes. If you do use PTA let us know how it goes. Good luck

You need to check this out with PTAS - it's way beyond PPC/POPLA appeal stages for the £16 guaranteed outcome, I'm not sure what they can do for you so late in the day.

Let us know how you get on with this - if nothing else, it will be useful to others who, via search, link to this thread in the future.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
