Sorry if this has already been discussed, but I hope somebody can help me.
I received a PCN from APCOA for dropping off in an unauthorised zone at Bham Airport.
They notified me outside of the 14 day requirement of POFA para 9- so following advice from the forums I appealed. Today, I received a letter rejecting my appeal on the grounds that under BPA guidelines (June 2014), the maximum permitted time to notify is 28 days. I have checked the guidelines and they are correct. They have sent me the appeal nos for POPLA and I have found a template, which states that I am appealing as the coy were out of time, but were they? Also, I am I now out of time to qualify for the 50% discount? Thanks

APCOA no longer alleges keeper liability at its airport sites so the PoFA timescales are irrelevant.
Your options now are:
(i) ignore them (assuming you haven't disclosed the identity of the driver); there is no keeper liability so they can only pursue the driver, and if they don't know who that was...
(ii) appeal using the PoPLA code and all the usual appeal points, except don't bother with "out of time or non-compliant NtK", that one will not fly.
Whether you are out-of-time for the 50% discount is irrelevant since 50% of the £0.00 you owe them is £0.00. Pay them nothing, they are powerless.Je suis Charlie.0 -

What are you talking about 'they are correct'? You checked guidelines by the BPA as if it makes a difference?! Anyway as already said there is no keeper liability at an Airport so obviously you will win this if using a recent Airport POPLA appeal template.
