CPM Parking Fine in Estate

Hello,

We bought a new build flat in a new build estate 2 years ago.

Last month, CPM (UK Car Park Management) have put up signs around the entire estate and every resident received a letter through the door with a map of all parking spaces you are allowed parking in.

One spot in the estate we have always parked on, has never been an issue and is in the corner out of the way but not on the map.

I woke up today to find that I now have a parking ticket of £100 or £60 within 14 days.

Contravention 1:
No parking outside of a marked bay

Contravention 2:
No parking outside of a designated area

This vehicle was parked on private property in contravention of the site parking restrictions as displayed on the signage or permit.

I have read other topics about this company saying to not pay the fine but I am unsure that because this is on private land that I have to pay it?

Any information would be much appreciated.

    The main information you need is in the newbie thread (see my signature) which tells you how to appeal. Do not ignore, but do not pay. Appeal.

    Come back and ask if any further questions, but since all PPCs work on private land, yours is no different.

    As well as the Newbie thread you might want to look at your lease. If it makes no mention of parking conditions or says you have a right to park then you should complain like hell to the managing agents saying the CPM made up rules do not trump your lease.

  • The lease mentions nothing about parking restrictions and at the time of buying the property, the estate agent said they we could park anywhere that was not a numbered parking spot but at this time there was not PPC operating.

    I did read the newbie thread but was unsure because I know that I parked in a spot that was not a marked bay but were it is out of the way and I have parked their for the last 2 years, I didn't think it would be a problem.

    Two pronged attack then - use the template in the Newbies thread as an appeal to CPM ( it really doesn't matter what happened ! ).

    Also get onto the managing agents telling them they need to cancel the ticket because your lease makes no requirements about parking. Point out to them that your lease was checked by your solicitor before purchase and had no mention of parking restrictions rather that you have a right to park anywhere. Tell them that as the property owner you reject the parking scheme and will be ignoring it.

    Hold your appeal until you get the Notice to Keeper (NtK) which you shouldn't receive until days 29 to 56 following the date of the parking incident.

    Plenty of time before then to read the NEWBIES sticky: the more you understand this stuff, the better you will be able to deal with it.

    Just wait for the NTK to arrive in over a month's time. DO NOT appeal yet unless you are not the keeper (e.g. company car). Did you read the Newbies thread not realising what 'private land' is? ALL THE CASES WHERE A PPC ISSUES A TICKET ARE ON PRIVATE LAND!
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Were the residents consulted about bringing in a PPC?

    In my view, where non-resident/guest parking has been deemed to be a problem and the management company has decided that "something must be done", then leaseholders should be consulted and their views prevail.

    If parking management via PPC is thought to be the answer by the majority, then a 2-tier charging system should be in force. If a resident forgot to display their pass, then their charges should be cancelled with a small admin charge of no more than £5 made. Those who have no right to be there could then be charged the higher amount.

    But, of course, they would then come here and e would advise them how to get off at no cost.

    Something wrong with my logic here.

    And when rogue parkers 'get the message', all that's left for the PPC to harass are the residents. They have to earn a crust somehow, especially as the MA will have signed a contract with them, possibly for 5 years!

  • Residents were consulted that they might bring this in but we was against it but the majority was for it (all the people that got a parking space with their property lol).

    Never had an issue with parking spaces in 2 years until they brought this in.

    A few members have said do not appeal until after receiving the NTK but in the newbies thread the flowchart says do it straight away and the walkthrough process says wait until after 28 days and then the description again says wait?

    Is CPM a small company? Some light shed for this particular company would be great

  • After reading through a lot of the threads and what members have suggested is that I need to wait for my NTK before sending of the appeals template
