It doesn't really matter how often the access is used at the moment - things can change. Unless you're happy if the neighbour or a new neighbour starts to use it half a dozen times of day or more, don't buy the house.
Also be aware that the neighbours/friends/delivery men have no obligation to close gates on the right of way. If you have a dog or children, would it be a problem if the gates were left open?0 -

At that point I would assume that a lack of answer implies the worst possible answer. So in your case I would assume that the neighbours use the access reasonably frequently and that the boiler hasn't been installed correctly or serviced regularly.
Tell them that you are assuming this and want to adjust your offer accordingly (or not).
[Incidentally, how have you asked? Via solicitor? Or via estate agent? is it worth trying the other route?]0 -
If you want the boiler serviced then it's likely that you're going to have to pay for it. However as others have said, there should be a recent safety certificate.Don't listen to me, I'm no expert!0

I've been enquiring via my solicitor.
I think we will end up giving up on answers. I'm hoping when we get the boiler checked that it won't need a major service.
On the access point - there is right of way but I don't envisage it being a garden where we let the kid play without supervision. There is a park about 5 mins away. Also, I think the gate has a Yale lock on it and is also weighted so it swings shut. It's a safe area and to access the side gate you have to go down a very discreet alley which is tucked away. This right of access might bother some people but it doesn't bother us too much. It's just a question of whether if I don't get answers now, will it be a headache when it comes to re-selling...0
